The short answer

A Jupiter dock or lift permit needs a sealed survey less than 6 months old showing mean high water and the waterway width. Jupiter borders two aquatic preserves, so river and sound docks face the 500 sq ft Outstanding Florida Waters limit and SFWMD review.

Signs your dock needs repair

Fix these early. Salt water and sun speed up every one.

  • Soft, split or loose boards
  • Wobbly handrails or cleats pulling out
  • Pilings with deep cracks or worn at the waterline
  • Sagging framing between pilings

Typical project sizes

Most repairs are a section of decking, a few pilings or a set of rails. Florida law exempts repair or replacement of a dock within 5 ft of the same location, no larger than before and with no fill.

A survey less than six months old

Jupiter dock permits need a signed and sealed survey made within 6 months of the application, showing setbacks, the mean high water line in NAVD88 and the waterway width (Code 27-2626). An older survey from the house purchase usually has to be redone.

Like-for-like repairs often take the lighter route; anything bigger gets the full permit.[1]

Two aquatic preserves meet at Jupiter

The Loxahatchee River-Lake Worth Creek Aquatic Preserve (1,800 acres, 1970) borders Jupiter and Tequesta, and the Jensen Beach to Jupiter Inlet Aquatic Preserve (23,000 acres) has been Outstanding Florida Waters since 1979. On those waters the state dock exemption falls to 500 sq ft, and SFWMD approval is needed for structures in natural waterways.

Grass and hard bottom decide where the dock can go and how high it sits.[2][3][4][5]

Half the waterway stays open

Jupiter keeps a centreline channel of 50% of the waterway width unobstructed, or at least 15 ft where that is impossible, and allows only rectangular, T and L docks unless the Director approves another shape. Piles for docks and lifts are laid out against that channel line first.

A repair that changes the footprint has to meet today's limit, not the one the old dock was built to.[6]

What makes Jupiter different

Town Code 27-2626 keeps half of every waterway clear: a centreline channel of 50% of the waterway width must stay unobstructed, or at least a 15 ft channel where that cannot be met. Only rectangular, T and L shaped docks are allowed unless the Planning and Zoning Director approves another shape.[6]

Who approves what

The Town's checklists ask for FDEP self-certification or exemption verification, Army Corps approval if not included in the DEP decision, and SFWMD approval for structures on submerged lands or in natural waterways such as the Loxahatchee River, the Intracoastal Waterway and Sawfish Bay.[5][1]

Permits in Jupiter

  • Town of Jupiter Building and Planning and Zoning: Marine structure permits; dock waivers under Town Code 27-2626.
  • Florida DEP or South Florida Water Management District: FDEP self-certification or exemption verification for canal docks; SFWMD approval for structures in the Loxahatchee River, the Intracoastal and Sawfish Bay.
  • US Army Corps of Engineers, Jacksonville District: Army Corps approval where the FDEP decision does not include it, as the Town checklists note.

Which dock repairs need a permit?

Miami-Dade DERM exempts replacing decking or handrails to the original dimensions, removing old piles and dilapidated docks, and replacing fender or mooring piles in the same spot when a contractor with a certificate of competency gives DERM 24 hours' notice. Anything that changes the footprint needs a permit. Your city may still need a building permit.[9]

Repair or rebuild?

If the pilings are sound, new decking and framing are usually good value. If many pilings are failing, a rebuild within 5 ft of the old footprint keeps the state exemption and is often the better long-term choice.[4]

Frequently asked questions

Can I use my closing survey for a dock permit in Jupiter?

Only if it is less than 6 months old and shows setbacks, mean high water in NAVD88 and the waterway width. Most owners need a new one.

Why are river docks in Jupiter harder to permit?

The Loxahatchee and Jupiter Sound are aquatic preserve waters, so dock exemptions are smaller and SFWMD must approve structures in natural waterways.

What dock shapes are allowed in Jupiter?

Rectangular, T and L docks, and shared U-shaped terminal platforms, unless the Planning and Zoning Director approves another shape. Half the waterway must stay open.
