The short answer

In Jupiter, a replacement bulkhead may go up to 18 inches waterward of the existing one only once (a one-time allowance under Town Code 27-2624), and the top of the concrete cap must be at or below the property's base flood elevation (Town of Jupiter, 2021). Surveys must show the mean high water line in NAVD88.

Typical project sizes

Most residential lots have 50 to 150 feet of waterfront, so a full replacement is usually a five or six figure project, while cap, crack and tieback repairs are much smaller. Fort Lauderdale's 2016 survey priced engineering and permitting alone at $2,000 to $5,000 per job.

Cap height works the other way here

Most cities set a minimum height. Jupiter's checklist sets a ceiling: the top of the cap, in NAVD, must be less than or equal to the property's base flood elevation under Town Code 27-2624(8). Plans state the cap elevation for that check.[1]

Riprap and mangroves

The survey must show existing and proposed riprap and mangroves under Town Code 27-262, and plans show mean low water and whether the grade below is under water.[1]

A cap no higher than base flood elevation

Jupiter caps seawalls from above: the top of the concrete cap, in NAVD, must be at or below the property's base flood elevation (Code 27-2624(8)). Since FEMA's new maps took effect on 20 December 2024, the BFE on the current map is the number to check before a cap is designed.

Height is the first question on any wall job here, because it decides whether a repair can stay at the current cap or turns into a raise.[1][2]

A survey less than six months old

Jupiter dock permits need a signed and sealed survey made within 6 months of the application, showing setbacks, the mean high water line in NAVD88 and the waterway width (Code 27-2626). An older survey from the house purchase usually has to be redone.

We build that permit path into the schedule from the first site visit.[3]

What makes Jupiter different

Town Code 27-2626 keeps half of every waterway clear: a centreline channel of 50% of the waterway width must stay unobstructed, or at least a 15 ft channel where that cannot be met. Only rectangular, T and L shaped docks are allowed unless the Planning and Zoning Director approves another shape.[4]

Who approves what

The Town's checklists ask for FDEP self-certification or exemption verification, Army Corps approval if not included in the DEP decision, and SFWMD approval for structures on submerged lands or in natural waterways such as the Loxahatchee River, the Intracoastal Waterway and Sawfish Bay.[1][3]

Permits for seawalls in Jupiter

  • Town of Jupiter Building and Planning and Zoning: Marine structure permits; dock waivers under Town Code 27-2626.
  • Florida DEP or South Florida Water Management District: FDEP self-certification or exemption verification for canal docks; SFWMD approval for structures in the Loxahatchee River, the Intracoastal and Sawfish Bay.
  • US Army Corps of Engineers, Jacksonville District: Army Corps approval where the FDEP decision does not include it, as the Town checklists note.

Which permits does seawall work need?

In Miami-Dade, any work in, on, over or upon tidal waters needs a DERM Class I permit under Section 24-48 of the County Code, including inside cities. Minor repairs are exempt, cap and tieback work gets an expedited authorisation, and rebuilding a wall at the mean high water line or up to 18 inches waterward is a short-form permit approved by staff.

The city building department also issues a structural permit. A state exemption does not remove county and city permits: Florida Statute 403.813 says its exemptions do not relieve anyone from county and municipal requirements, so in Miami-Dade a DERM Class I permit still applies.[5][6]

How long does a seawall last?

Fort Lauderdale's seawall ordinance FAQ assumed a design life of about 50 years, and city engineers described a 30 to 50 year lifespan for a wall built today. Salt water, wave action from boat wakes and rising tides shorten that when cracks and failed joints are left open.[8]

Why heights matter now

Cities are raising the bar. Miami Beach requires new and substantially repaired seawalls to reach 5.7 ft NAVD, Coral Gables sets bulkheads at a minimum of 6 ft NGVD 1929, and Fort Lauderdale requires 5 ft NAVD. A repair that triggers these rules can turn into a raising job, so we check the local standard before we price.[7][10][11]
